At the beginning of 2005, we began providing mediation services as K&A Mediation. We are pleased to report that K&A Mediation has been favorably received by plaintiffs, defendants and attorneys and carriers alike. We are presently on the pre-approved lists of several major insurance carriers, as well as self-insured entities.

We are confident that our varied experiences as litigators, multicultural backgrounds and ability to effectively communicate and negotiate with your Spanish speaking clients will enable us to help you resolve your cases at mediation. We offer the experience, enthusiasm and creativity you need to resolve cases.

Our offices have been designed to comfortably accommodate multiparty mediations. We are centrally located at the Chase Bank Building, located at the corner of SE 2nd Avenue and SE 2nd Street, about midway between the Bank of America Building and the Wachovia Tower. The building offers valet parking at a reasonable price for your convenience. Please refer to our website for driving directions. We are also available to conduct mediation in other locations if requested by the parties.

Our rate is $150.00 per hour, per party, billed in half hour increments for cases involving two (2) parties, with NO minimum number of hours required and NO cancellation fees. For matters involving three (3) or more parties, our rate is $110.00 per hour, per party, billed in half hour increments. If asked to travel beyond the Downtown Miami/Brickell area to conduct mediation, we charge $50.00 per party per hour (plus parking) for our actual travel time. It is our practice to not book more than one (1) mediation per day per mediator so you and your clients will have our full attention.

A short summary of our biographies and qualifications to serve as your mediator follows:


Eric Scott Kleinman has been practicing law since 1992 and has been a Certified Circuit Court Mediator since 2004. Born in Ellenville, New York, Eric was valedictorian of his high school class and a cum laude graduate of the University of Rochester in 1989, with a dual major in Political Science and Psychology. In 1992, Eric graduated cum laude from the University of Miami School of Law. Before founding Kleinman & Arrizabalaga, P.A., Eric practiced law for nine (9) years at a large Miami based law firm, becoming a shareholder in 2000, where his practice focused on being counsel to insurance companies advising about and litigating matters of insurance coverage and bad faith, and, defending insurance companies, self insured companies and individuals from significant personal injury and wrongful death claims. In his current practice, Eric represents both plaintiffs and defendants in personal injury matters and commercial litigation. He also represents buyers and sellers in commercial and residential real estate transactions. Eric’s areas of expertise include product liability, automobile accidents, premises liability, and negligent security. Eric is a member of the Florida Bar, and authorized to practice in Federal Courts, including, the Southern District of Florida and the Eleventh Circuit Court of Appeal. In his legal career, Eric has handled cases throughout the State of Florida, mediated hundreds of cases as a litigator and tried cases for Kmart, Builders Square, Scotty’s, Winn-Dixie, insureds of Reliance Insurance Company, Hartford Insurance Company and individuals.


Markel Arrizabalaga has been practicing law since 1994, has been a Certified Circuit Court Mediator since 2004 and has been an agent of Attorney’s Title Insurance Fund since 2005. Born in Miami, Florida, Markel attended high school at Belen Jesuit Preparatory School and is a graduate of the University of Miami School of Business and thereafter the University of Miami School of Law. Before founding Kleinman & Arrizabalaga, P.A., Markel practiced law nearly ten years at a large Miami-based firm, becoming a shareholder in 2002. In his trial practice, Markel has represented a variety of insurance companies, corporations, health care companies and individuals in connection with personal injury, property damage, insurance coverage, employer liability and commercial issues at the claims and litigation stages. In addition, Markel also currently handles residential and commercial real estate transactions and real estate litigation, including the sale, purchase and lending, commercial leasing, evictions and foreclosures. Markel is admitted to the Florida Bar and the Southern District of Florida. In his legal career, Markel has handled cases and transactions throughout the entire State of Florida and has tried numerous cases representing self insured companies, insurance carriers on a first party basis, their insureds and individuals.
